Sept. 3 — The IRS has already shared the residential addresses of more than 40,000 foreigners with immigration authorities, who are seeking to have the confidential information of at least 1 million more people incorporated directly into their database.
The information was taken from the 1040, W2 and 1099 income tax return forms filed by taxpayers, “which are now sent directly to ICE’s immigrant database,” as explained by the Asian Law Caucus.
The details of how and what information the IRS shares with Immigration and Customs Enforcement (ICE) were revealed thanks to the lawsuit filed by the Community Economic Development Center (CEDC) of Southeast Massachusetts on behalf of ALC and Greater Boston Legal Services.
The White House agreed to share with the plaintiffs the specifics of the settlement, in which ICE seeks to have the confidential information of at least 1 million more people sent directly to them.
The Trump administration has also ordered federal agencies to allocate personnel, including 250 IRS agents, to its mass deportation program.

Corinn Williams, director of the CEDC, expressed serious concerns in a statement about the need to file a legal complaint for the IRS to disclose the details of the agreement with ICE about taxpayer data, which is supposedly confidential, as specified by law.
“This [IRS policy change] has left our members exposed, scared and uncertain about their families’ futures,” she added.
Josh Rosenthal, director of ALC’s labor rights program, said the legal battle is far from over and that they will be vigilant to ensure that immigration agents respect privacy laws.
For her part, Luz Arévalo, senior attorney at Greater Boston Legal Services, warned that abuse of privacy laws can generate a domino effect impacting not just immigrant families.
“By eroding the integrity of the tax system, it will end up hurting everyone,” she said.
