Attorneys for BDO USA have notified the accounting news website Going Concern of their intent to pursue a defamation claim against the online media outlet, according to a notice the firm of McDermott Will & Schulte sent on October 20, 2025.
In the letter, the firm cited an article on the Going Concern website that included excerpts from a Bloomberg article about layoffs at the firm. The letter then claims that Going Concern made defamatory comments when the author further suggested that BDO had audited a company’s financial statements, then suggested the consulting firm “provided non-public information” to another company.
The letter says it is intended to put Going Concern’s parent company CollegeFrog, as well as CollegeFrog CEO Jeffrey Phillips and author Adrienne Gonzalez, “on notice that potential imminent litigation may be forthcoming.”
Going Concern declined to comment.
